UNANIMOUSLY RESOLVED that:
a. The application for Rezoning from General Residential Subzone (GR4) to General Business Subzone 1 (GB1) on Erf 118811 Cape Town BE REFUSED in terms of Section 98(c) in terms of the Municipal Planning By-Law, 2015.

b. The application for City Approval on Erf 118811 Cape Town BE REFUSED in terms of Section 98(c) in terms of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to amend:

7.1.1 The current rezoning application and proposal pertaining to the approved dwelling used for the shop on the subject property, Erf 118811, will adversely impact on the 15 bays used by the contiguous Erf 118810.

7.1.3 The proposal will result in adverse transport impacts and parking congestion in the surrounding neighbourhood roads.

7.1.4 The application does not provide accurate information about the relationship between Erf 118810 and Erf 118811 in terms of existing utilization and proposed utilization; and a correct understanding of this relationship is necessary for a proper evaluation of rezoning.
