UNANIMOUSLY RESOLVED that:
The application for the removal of title deed conditions, permanent departures and Council’s approval as set out in Annexure A in respect of Erf 887 Oranjezicht, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend:
7.1.6 The removal of the restrictive conditions complies with Section 39(5) of the LUPA and Section 47 of SPLUMA as motivated in Section 6.3 of the report
Correction to the body of the report:
1.2.4 (g):
‘…The requirement for reciprocal right-of-way servitudes for access purposes be registered over the proposed 2 units in favour of each other, but this will only be required if the owner subdivides the 2 units’.
