UNANIMOUSLY RESOLVED that:
a. The application for the rezoning of Erf 94992, Cape Town, as set out in Annexure A, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to conditions contained in Annexure A.
b. The application for a departure from the Development Management Scheme, as set out in Annexure A, for Erf 94992, Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
c. The application for City approval in terms of the Development Management Scheme, as set out in Annexure A, for Erf 94992, Cape Town, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with Annexure C.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add:
7.1.7 The proposal satisfies the desirability criteria as set out in Section 99(3) of the Municipal Planning By-Law, as listed in paragraph 6.2.4 of the report

2. CONDITIONS OF APPROVAL IMPOSED IN TERMS OF SECTION 100 OF THE BY-LAW
2.1 Development Contributions:
Prior to transfer, the owner shall pay a financial contribution towards the provision of bulk civil engineering services prior to building plan approval, with the amount of R 35 158.36 as determined by the Director TCT: Asset Management and Maintenance. Such financial contribution shall be subject to escalation to be calculated as follows:
- calculations shall be per month or part thereof;
- the escalation shall be based on the Consumer Price Index (CPI) as published in the Statistical News Release by Statistics South Africa
- the CPI used in the calculation will be those of a twelve-month period prior to the current financial year
- the escalation rate will be revised annually on 01 July
