RESOLVED that:
a. The application for subdivision, departures relaxation of title deed conditions, as set out in Annexure A, on Remainder Erf 3099 Camps Bay, BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law 2015.

b. The application for relaxation of title deed conditions, as set out in Annexure A, on Remainder Erf 3099 Camps Bay, BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law 2015, subject to the conditions contained in Annexure A.

REASONS FOR DECISION
The MPT REFUSED the application for the reasons set out in the Planner’s Report and agreed to amend as follows:

7.1.3 The subdivision is not compatible with the surrounding cadastral erf sizes

7.2.1 The application does not comply with the minimum threshold requirements set out in Section 99 (1) of the Municipal Planning By-Law.
7.2.2 The application is not desirable in terms of Section 99(3) of the By-Law

Add new reasons:
The relaxation of the relevant title deed condition is not regarded as being in the public interest

The subdivision will interfere with a significant natural drainage system from Table Mountain and the proposal does not provide adequate mitigation to accommodate this

Delete the following reasons from the report:
7.2.3
7.2.4
7.2.5
Update numbering sequence accordingly.
