Resolution details
RESOLVED that:
a. The removal of the restrictive title deed conditions as set out in Annexure A in respect of erven 8666, 901 and 902 Milnerton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.
b. The amendment of township establishment conditions imposed in terms of Ordinance No 33 of 1934 to allow for a residential development on erven 8666, 901 and 902, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.
c. The rezoning from Single Residential SR1 to General Residential Subzone GR4 in respect of erven 8666, 901 and 902, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in the attached Annexure A.
d. The consolidation of erven 8666, 901 and 902 Milnerton in accordance with the plan attached as Annexure D, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.
e. The regulation departures as set out in Annexure A in respect of erven 8666, 901 and 902 Milnerton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the plan attached as Annexure C, subject to the conditions contained in the attached Annexure A.
f. The site development plan for the consolidated erven 8666, 901 and 902 Milnerton, as per Annexure C, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in the attached Annexure A.
g. A landscaping plan be included in the Site Development Plan and such plan must address mitigating measures as stated in the Visual Impact Assessment in respect of erven 8666, 901 and 902 Milnerton to BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend Annexure A:
2.30 Implementation of mitigation measures recommended in the Visual Impact Assessment and a construction Environmental Management Plan (CEMP) for the installation of services and the construction of the residential development to be submitted for approval prior to the submission of building plans. The CEMP must address the following;
