UNANIMOUSLY RESOLVED that:
a. The application for subdivision of the property into three portions, for Erf 220, 69 High Level Road, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with the subdivision plan (Annexure C1, subject to the conditions contained in Annexure A.
b. The application for the amendment of title deed restrictions, for Erf 220, 69 High Level Road, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as set out in attached Annexure A.
c. The application for permanent departures, for Erf 220, 69 High Level Road, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as set out in attached Annexure A.
d. The application for City approval, for Erf 220, 69 High Level Road, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, as set out in attached Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report. Reasons for refusal (6.5) were rejected.
Amend Annexure A:
1 (update heading) Applications approved in terms of Section 98(b) of the By-Law
1.3 Item 126(a): To permit the garage floor on Portion 3 to be raised 1.73m in lieu of 1.5m above existing ground level
1.4 Item 126(b): To permit the construction of retaining walls to a height of 3.36m in lieu of 2m to provide for a driveway to the garage on Portion 2
Departures for refusal (except for old 2.1.9 and old 2.1.11) to be approvals new items 1.4.1 to 1.4.10
2 Applications refused in terms of Section 98(c) of the By-Law
2.1 (old 2.1.9 renumbered to 3.1): Departure from Item 22(d): To permit the building on Portion 3, further than 12m from the street, to be set back 0m in lieu of 3m from the common boundary with Erf 2101.
2.2 (old 2.1.11 renumbered to 3.2): Departure from Item 22(c): To permit the building on Portion 3, further than 12m from the street and within 3m from the western common boundary with Erven 2101 and 2102, to have a height of 6.49m in lieu of 4m.
Delete old condition 3.2 (A maximum of two vehicle carriage way crossings shall be permitted on Ben Nevis Road)
3.3 (old 3.4 renumbered to 3.3): Prior to building plan submission, the owner shall submit a Site Development Plan, generally in accordance with Annexure C2, and the approved departures, for the approval of the delegated official (Development Management).
Update numbering sequence accordingly.
