UNANIMOUSLY RESOLVED that:
a. The application for City approval in terms of Item 162 of the DMS on Erf 128074, 13 Duke Street, Observatory, as per Annexure A and shown on the Site Development Plans attached as Annexure C, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.

b. The application for departures on Erf 128074, 13 Duke Street, Observatory, as per Annexure A and shown on the Site Development Plans attached as Annexure C, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.

c. The application for Council consent in terms of the title deed conditions (including related to the above applications) on Erf 128074, 13 Duke Street, Observatory, as per Annexure A BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to delete reasons for refusal.

Delete condition 2: reword to ‘Delete point 2’ (it is not a condition)

Because point 2 is deleted, point 3 becomes the new point 2 and must be amended accordingly, ie.
Delete 3.1 and update numbering sequence
2.1 (old 3.2, now renumbered to 2.1) Prior to building plan approval, the owner shall submit a Landscaping Plan which shows planting on the edges of carport, sides and lateral boundary to lessen the visual impact of the carport, a proposed tree on the property to the west of the existing veranda, with the position of the tree being to the satisfaction of the delegated official (Development Management).
2.2 (old 3.3, now renumbered to 2.2) Building plans showing the proposed first storey addition, dormer window and covered patio and kitchen extension shall be substantially in accordance with the Site Development Plans attached as Annexure C.
