Resolution details

UNANIMOUSLY RESOLVED that:
a. The application for the subdivision of Erf 3067, Kloof Road, Gordon’s Bay into 12 portions, 9 of which are earmarked for residential purposes and two for private road and 1 for private open space purposes, in accordance with Subdivision Plan No C1071/S30-3 dated October 2017, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A hereto;


b. The application for the approval of the site development plan for the abovementioned development, in accordance with Site Development Plan No MORGANS/CS/2017/01 dated 18 September 2017 and Planting Plan No MR-PP-01, REV.A, dated 19 January 2018, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT partially APPROVED the application for the reasons set out in the Planner’s Report, and partially REFUSED for the following reason:

The SDP application is not considered to be an appropriate application in the context of this development and Item 123 of the DMS and should rather be included as a condition of approval

Add to Annexure A:
2.3.1 Engineering and landscape features of the property shall be in general accordance with plan number MORGANS/CS/2017/01

2.3.2 A manual of architectural and landscape design guidelines, informed by the recommendations of the VIA, shall be submitted by the applicant to the satisfaction of the authorized official which shall be administered by the Home Owners Association and provide overarching guidance for evaluating individual property site development plans

2.3.3 Renumber condition 2.3 to read as condition 2.3.3

Subsequent numbering sequence to be updated

Delete the words ‘Site Development Plan’ from Annexure D1 in the case officer’s report.
