UNANIMOUSLY RESOLVED that:
a. The application for a consent use in terms of item 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit the operation of a house shop from a portion of erf 2612, 7 Snapper Street, Hagley, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as set out in the attached Annexure A.

b. The application for a permanent departure in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit a building line departure of 2.8m in lieu of 3.5m for the house shop from the Snapper Street on erf 2612, 7 Snapper Street, Hagley, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

Amend Annexure A:
1.1 Temporary departure to permit a house shop on a portion of the subject property.
2.1 The temporary departure approval shall be limited to a validity period of 3 years.

2.5 That the house shop hereby permitted shall only operate or deliveries be received between the hours of 07:00 to 21:00 from Monday to Saturdays, and until 13:00 on Sundays.
