UNANIMOUSLY RESOLVED that:
The application in terms of Section 42(c) of the City of Cape Town Municipal Planning By-Law, 2015 for a temporary land use departure in order to permit sand mining (removal and levelling of a sand dune) on erf 12414 and a portion of remainder erf 9930, Wesbank, Blue Downs, BE APPROVED in terms of Section 98(b) (iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and add reason 7.1.7

For practical reasons, the applicant is granted a period of 3 months instead of 2, to cover all aspect in paragraph 2.2 in Annexure A.

Amend Annexure A:
1.1 Temporary land use departure in order to permit sand mining on the subject property for a period of three months in order to remove a remnant sand dune located thereon.
