UNANIMOUSLY RESOLVED that:
a. The application in terms of the Municipal Planning By-Law, 2015, Section 42(d) to allow for the proposed subdivision of Erf 3099, 1 Livingstone Road, Kelderhof Country Village, Croydon into two portions. Portion 1: 369m2, and Portion 2: 459m2 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to conditions stipulated in Annexure A.
b. The regulation departure for the relaxation of the 4m permissible height within the 3m common building line to 7.61m to allow for the proposed dwelling on Portion 1 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to conditions stipulated in Annexure A.
c. The regulation departure for the relaxation of the 3.5m street building line (along Livingstone Road) to 2.58 to allow for the proposed portion of the new dwelling on the Portion 2 (bedroom, passage and living area) BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
d. The regulation departure for the relaxation of the 4m permissible height within the 3m common building line to 7.55m to allow for the proposed dwelling on the Portion 2, BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT partially APPROVED and partially REFUSED the application for the reasons set out in the Planner’s Report.
