UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 15 000.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 105849, Sanddrift in accordance with Drawing no. R/105849/18; dated 27/03/18, attached as Annexure B, for the unlawful second dwelling conversion and garages, and approved in terms of Section 98(b) of the said By-Law (2015).

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend as follows:

6.1 The gravity of the contravention is considered to be moderately serious, and the owners have willfully engaged in illegal construction.

6.3 The unlawful structure which is occupied without approval, could pose a threat to the safety, health and wellbeing of the occupants; occupying a building without approval can be a risk
