UNANIMOUSLY RESOLVED that:
a. The application in terms of Section 42(a) of the City of Cape Town Municipal Planning By-Law, 2015 for the rezoning of remainder cape farm 694 and erf 38227, New Woodlands, Mitchells Plain from community 2 to sub-divisional area overlay zone (dwelling houses, retention pond, community facility, business uses, public open space and public roads), BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.
b. The application in terms of Section 42(d) of the City of Cape Town Municipal Planning By-Law, 2015 for the consolidation of remainder cape farm 694 and erf 38227, New Woodlands, Mitchells Plain in accordance with drawing no’s: Consolidation: Farm 694/RE & erf 38227 (see Annexure C), BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend heading in 7.2:
Reasons for the recommended decision for approval of the rezoning and subdivision may be summarised as follows:..
Correct numbering sequence of ‘reasons for decision’ in the case officer’s report.
Amend renumbered reason 7.2.3 (incorrectly renumbered as 7.2.9):
The proposal will contribute to addressing the dire need for subsidy housing at a suitable density.
Add new 7.8:
The criteria for consolidation in Section 99(ii)b of the Municipal Planning By-Law are complied with
Add new 7.9:
The application has been based on a clear assessment of social facility needs
Correct heading in Annexure C (Proposed consolidation plan):
‘Farm 694/re and erf 38227 to be consolidated’
Correct numbering sequence in Recommendation
Amend Annexure A:
1.2.1 Rezoning of remainder cape farm 694 and erf 38227, Mitchells Plain Community 2 to sub-divisional area overlay zone (dwelling houses, public roads, public open space, utility use and associated uses).
2.1 A detailed contextual development framework plan, generally in accordance with the development framework attached as Annexure E, shall be submitted for approval to the Director: Development Management as a component of the package of plans as provided for in the Development Management Scheme prior to or concurrently with an application for subdivision of the subject property.
Note: The conditions related to the subdivision, which has not been dealt with, is to be conditioned at a time when the development framework is adopted
