RESOLVED UNANIMOUSLY
That an administrative penalty in the amount of R 2 800.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 747 Zeekoevlei in accordance with plan no A01.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out below:
1. A portion of the structure contravenes the Development Management Scheme.
2. The contravention is considered to be of medium duration.
3. The gravity of the contravention is considered to be low.
4. The owner acknowledges that he was aware that the building work was unlawful.
5. As far as can be ascertained the owner of the property has not previously contravened this By-Law or any other planning law.
6. The owner knowingly contravened the By-Law
