Resolution details

Although the applicant, Ms Karla Burger (Elco Property Developments) was invited and given an opportunity to address the panel, she declined to attend.

After discussion, the panel agreed by 4 votes to 1 that this matter be REFERRED BACK. This application to be resubmitted, addressing the following concerns:

1. Traffic and Visual Impact Assessment to be included in the case officer’s report
2. The report to indicate the interface treatment of the proposal with Marine Drive
3. The height to be re-assessed on the basis of the Visual Impact Analysis and included in the report
4. SPLUMA and LUPA to be adequately addressed in the case officer’s report with particular reference to the content of the objections submitted by the interviewee
5. Landscaping and appropriate water saving mechanisms to be clearly indicated

NOTE: The MPT has on 3 previous occasions requested that the implementation criteria and policy relating to SPLUMA and LUPA principles, as it may apply to Private sector developments, be given urgent attention

NOTE: Officials to note/check the numbering of title deed conditions as follows:
3A)5 should read 33A)5, and 3A)8 should read 33A)8
Confirm that 1A6 does not need to be deleted.
