UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 500 000.00 BE APPROVED for the unauthorised building work in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 3507 Milnerton in accordance with drawing nos: 38/16 – XP -200 Rev E; 38/16 – XP -201 Rev E; 38/16 – XP -202 Rev E; 38/16 – XP -204 Rev E; dated 06-03-2018; drawn by Enrica Van Der Linden & Richard Adcock, and such penalty BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 6.1, 6.2 and 6.3 as follows:

1. The nature, scale and gravity of the unauthorized building work is considered to be very serious.
2. The owner/developer knowingly and willfully engaged in the unlawful activity.
3. The unauthorized building work presents a safety risk as the work commenced without an approved plan.
