After discussion, the panel agreed that this matter be REFERRED BACK. This application to be resubmitted, addressing the following concerns:
1. The application must comply with the minimum threshold requirements, ie. Section 99(1) of the Municipal Planning By-Law to ensure procedural correctness in the processing of the application
2. The case officer must obtain a comprehensive assessment of the merits of the application wrt the title deed amendments and departure
3. The parking concern to be clearly presented and resolved upon departmentally
4. The Jo-Jo water tanks located in the road reserve be resolved.
