UNANIMOUSLY RESOLVED that:
1. The application for a consent use in terms of item 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit the operation of a place of instruction (ECD centre) from a portion of erf 4127, 21 Tana Street, Mitchells Plain, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions as set out in the attached Annexure A.
b. The application for permanent departures in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit:
- Common boundary building lines of 0m in lieu of 5m from the north and west boundaries
- A stop and drop off area in lieu of three (3) parking bays and a stop and drop off area
BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015 in accordance with the drawing attached as Annexure C.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend 7.1.5 as follows:
The proposal poses no adverse noise impacts and the issue of safety has been adequately addressed, and has been adequately dealt with in the conditions.
