UNANIMOUSLY RESOLVED that:
a. The application in terms of Section 42(a) of the City of Cape Town Municipal Planning By-Law, 2015 for the rezoning of erf 36576, Mitchells Plain, corner of AZ Berman and Highlands Drive, Lentegeur from agriculture to sub-divisional area overlay zone (dwelling houses, retention pond and public roads), BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.
b. The application in terms of Section 42(d) of the City of Cape Town Municipal Planning By-Law, 2015 for the subdivision of erf 36576, Mitchells Plain, corner of AZ Berman and Highlands Drive, Lentegeur into 156 single residential 1 (SR1), 1 open space 2 (OS2) and 1 transport 2 (TR2) zoned portions, BE APPROVED in terms of Section 98(b)(iii) of the City of Cape Town Municipal Planning By-Law, 2015 subject to the conditions attached to Annexure A.
c. The application for permanent departure in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 in order to permit zero (0) on-site parking bays in lieu of one (1) on-site parking bay per dwelling unit BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend Annexure A:
2.15 First bullet: -hard and soft landscaping, indicating plant palate, tree staking, irrigation system requirements, removal of alien and plants, bill of quantities to be submitted 3 x months before the submission of detailed building plans
2.17 Portion 157 shall be fenced off for safety purposes by means of visually permeable fencing and access gates.
2.26 Servitude(s) shall be registered over all sewer services which fall outside the road reserve, with a minimum width of 3.0m or 2 x the depth, whichever is the greatest.
2.37 The electrical reticulation network shall be installed in the road reserve with a sidewalk width sufficiently wide to accommodate the electrical network required. Special attention shall be required where HV cables are to be accommodated.
