UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 350.00 for the unauthorized land use (ECD centre) and R0 for the unauthorized building work in terms of Section 129 and 42(q) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of Erf 2640, 4 Maracaibo Street, Malibu Village, Blue downs, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following:
6.5 The nature of the contravention is considered to be serious given the importance of health and safety requirements associated with ECDs.
