UNANIMOUSLY RESOLVED that:

An administrative penalty for the unauthorised land use (office and calibration workshop) in the amount of R 1 250.00 in terms of Section 129 and 42(r) of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 188, 33 Gourley Road, Penhill BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following:

6.4 The gravity of the contravention is not considered to be serious.
