UNANIMOUSLY RESOLVED that:

a. The application for departures, as set out on Annexure A, for Erf 15973 Cape Town at Salt River BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, in accordance with site plans in Annexure C

b. The application to permit the window on the south western common boundary to be setback 0m in lieu of 1.5m BE REFUSED in terms of Section 98(c) of the City of Cape Town Municipal Planning By-Law

c. The application for Council’s approval in terms of the Development Management Scheme, as set out in Annexure A, on Erf 15973 Cape Town at Salt River BE APPROVED in terms of Section 98(b) of the City of Cape Town Municipal Planning By-Law in accordance with site plans in Annexure C

REASONS FOR DECISION
The MPT partially APPROVED the application for the reasons set out in the Planner’s Report, and partially REFUSED the application for the following reason:

Windows will not be allowed in terms of the National Building Regulations.

Amend Annexure A:
1.3 Item 22(d): To permit the departure for the portion of the building beyond 12m from the street boundary to be 0m on the common boundary for 72% in lieu of 60% of the total remaining linear distance along the common boundary.

Application refused in Annexure A:
1.4 Item 22(e): To permit the window on the south western common boundary to be setback 0m in lieu of 1.5m.
