Resolution details

RESOLVED that:

The regulation departures proposed on erf 4634, 35 Athens Road, Table View, and as set out in Annexure A, BE APPROVED in terms of Section 98(b)(iii) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A, with accordance in plans in Annexure C.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend 7.1.4 as follows:

The proposed position and design of the building has been amended to reduce the impact on the adjoining landowners, addressing some of the concerns raised in respect of height, bulk, privacy and sunlight. Although there would be marginal impact in respect of sunlight on adjoining properties, it is considered acceptable given the location and context of the property, hence the proposed building line departures are supported.

Add new reason:
7.1.6 The landscaping on the lateral boundaries of the property would mitigate impact on neighbouring properties.

Amend Annexure A:
Delete 2.3
Delete 2.8
Delete 2.12 up to and including 2.17

Amend:
2.10 The landscaping plan (Drw no.: 4634_LP_003; dated 8 December 2017; compiled by Landscape Garden company) shall be implemented by and at the cost of the developer, in accordance with the approved landscape plan, within the first winter rainfall cycle following the issuing of the occupancy certificate.
