UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 2 950.00 BE APPROVED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of erf 13395, Milnerton in accordance with drawing no PW Feb 17-100, attached as Annexure B for the unlawful structure, and approved in terms of Section 98(b) of the said By-Law (2015).
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend reason 6.1 as follows:
The unauthorized building work was constructed by a tenant renting from the owner, although it appears to be a family member
Add new reason:
The unauthorized building work does have an impact on neigbouring properties because it is situated on the plot boundary.
