UNANIMOUSLY RESOLVED that:
The application for City Approval in terms of the Development Management Scheme and departures, as set out in Annexure A, for Erf 177344 Cape Town BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, in accordance with the plan indicated in Annexure C, subject to the conditions contained in the attached Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend conditions:
Renumber existing 2.2.1 to 2.2.2
New 2.2.1: Prior to the approval of the Development Plan (in 2.1 above), details of the following needs to be submitted to the department for approval:
Details of the proposed ‘common area’ pedestrian access (at Level 2) to the abutting Trafalgar Park and how this needs to be adapted to also enable public access off Upper Warwick Street to ensure an acceptable access arrangement and interface with the abutting public park facility
