UNANIMOUSLY RESOLVED that:
The deletion of the restrictive title deed condition as contained in Annexure A attached in respect of Erf 938, 33 Bay View Avenue, Tamboerskloof BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to amend one reason and add the following reason:
The proposal complies with LUPA Section 39(5) and SPLUMA Section 47.
Amend reason 6 as follows:
The deletion of the title deed condition will still see the Municipal Planning By-Law being the control to guide any future development of the site.
