UNANIMOUSLY RESOLVED that:
a. The application for the approval of Council in respect of the building in a Heritage Protection Overlay zone as contained in Annexure A attached in respect of Erf 680, 13 Main Road Green Point BE APPROVED, in terms of Section 98 of the Municipal Planning By-Law subject to conditions contained in Annexure A attached and in accordance with the plans in Annexure C2.
b. The application for the departures as contained in Annexure A attached in respect of Erf 680, 13 Main Road Green Point BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law subject to conditions contained in Annexure A attached and in accordance with the plans in Annexure C2.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend conditions:
3.2 An amended SDP shall be submitted and shall ensure the refined aesthetic/architectural designs of the street facades of the building and activation of the street edges or mimicking the activation of the street edges in line with the Urban Design Policy, in particular along Sydney Street and shall be to the approval of the Director: Development Management.
3.4 Proof of cession of a 1.75m wide portion of the property along Sydney Street ceded to the City shall be presented prior to final building plans unless determined otherwise by the Director: Development Management.
New condition 3.5: In amending the SDP the applicant should endeavor to incorporate affordable housing opportunities on at least 20% of the additional bulk rights that have been granted.
Delete condition 3.3
NOTE: Mr Nicks’ view on the wording of condition 3.5 excluded the word ‘endeavor’. In context of this aspect not necessarily forming part of the proposals tabled by the applicant (as was the case with other applications), Mr Nicks was outvoted and the panel inserted the word, as detailed in 3.5 above.
