Resolution details

UNANIMOUSLY RESOLVED that:

a. The consent use application in terms of Section 42(i) of the City of Cape Town Municipal Planning By-Law, 2015 to allow a freestanding base telecommunication station on erf 19669 Brooklyn, (Cape Town) BE APPROVED in terms of Section 98(b) of the Cape Town Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

b. The regulation depature application in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 to encroach into the street building line from 5.0 m to 2.0 m to permit a freestanding base telecommunication station on erf 19669, Brooklyn (Cape Town) BE REFUSED in terms of Section 98(c) of the Cape Town Municipal Planning By-Law, 2015.

c. The regulation departure application in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015 to encroach the 5.0 m common building line to 1.0 m to permit a freestanding base telecommunication station on erf 19669, Brooklyn (Cape Town) BE REFUSED in terms of Section 98(c) of the Cape Town Municipal Planning By-Law, 2015.

REASONS FOR DECISION
The MPT PARTIALLY APPROVED and PARTIALLY REFUSED the application for the reasons set out in the Planner’s Report. Reasons for refusal are as follows:

Setting the cell mast back from the common and street boundary lessens the visual impact.



Amend conditions:

Replace the word ‘General’ with ‘Notes’ – update numbering sequence.

Create new heading ‘Applications refused’ with respect to the departures.
