Resolution details

UNANIMOUSLY RESOLVED that:

a. The deletion of restrictive title deed conditions B1(b), B1(c), B1(d) and B2(e) in title deed T45924/2015, applicable to erf 3410, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.

b. The amendment of township establishment conditions of approval, applicable to erf 3410, Milnerton, as referred to in clause B1(b), B1(c), B1(d) and B2(e) in title deed T45924/2015 to allow for a block of flats, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

c. The regulation departures from the common boundary as set out in Annexure A and depicted on the sketch plans attached as Annexure D on 3410, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions set out in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.

Amend conditions:
2.1.1 That the parking layout be revised with the omission of parking bays B3 and B11, and that the access arrangements also be revised.
