UNANIMOUSLY RESOLVED that:
a. The deletion of restrictive title deed conditions A(a) in title deed T44676/2013, applicable to erf 11553, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The amendment of township establishment conditions of approval, applicable to erf 11553, Milnerton as referred to in clause A(a) T44676/2013 to allow for commercial/offices uses, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
c. The rezoning of erf 11553, Milnerton, from General Residential Subzoning GR3 to General Business Subzoning GB1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Correction in case officer’s report:
5.3 The subject property is currently consisting of a sectional title development and the proposal only applies to erf 11553. The unit is currently vacant.
Amend conditions:
2.3 The landscaping plan (Drawing no: 11553_LP_001), dated 28 August 2017 for Erf 11553, Milnerton as compiled by Landscape Garden Company shall be implemented by and at the cost of the owner/developer.
