UNANIMOUSLY RESOLVED that:
a. The removal of restrictive title deed conditions BI(a), BI(b), BI(c) , BI(d) and BI(e) in title deed T16128/2014 BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The amendment of township establishment conditions of approval as referred to in clause BI(a), BI(b), BI(c) , BI(d) and BI(e) in title deed T16128/2014 to allow for additions closer to the property boundary, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015,
c. The application for a departure from the street boundary building line from 5m to 1.93m in order to allow for a double garage on erf 5261, Milnerton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with drawing drawn by Architectural Design Studio, dated 06/02/2017 (vide Annexure C), subject to the conditions set out in Annexure A.
d. The application departure from the eastern common boundary building line from 3m to 0m in order to allow for a double garage on erf 5261, Milnerton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 in accordance with drawing drawn by Architectural Design Studio, dated 06/02/2017 (vide Annexure C), subject to the conditions set out in Annexure A.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Delete the words ‘the rezoning and’ from the title heading in 7.1.
Amend conditions:
1.3 The application for a departure from the street boundary building line from 5m to 1.93m in order to allow for a double garage on erf 5261, Milnerton in accordance with drawing drawn by Architectural Design Studio, dated 06/02/2017 in accordance with Annexure C.
