UNANIMOUSLY RESOLVED that:
a. The deletion of restrictive title deed conditions B.I.(a),(b)(c) and (d) in title deed SS45/1986, applicable to erf 4202, Milnerton, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
b. The amendment of township establishment conditions of approval, applicable to erf 4202, Milnerton, as referred to in clause B.I.(a),(b)(c) and (d) in title deed SS45/1986 to allow for commercial/offices uses, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
c. The rezoning of erf 4202, Milnerton, from General Residential Subzoning GR3 to General Business Subzoning GB2, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A in accordance with the plans attached as Annexure C..
d. The departure from the stipulated parking requirements applicable to offices on erf 4202, Milnerton, from 20 Bays to 17 Bays, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A in accordance with the plans attached as Annexure C..
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report.
Amend conditions:
2.4 The landscaping plan (Drawing no: 4202_LP _002), dated 27 October 2017 for Erf 4202, Milnerton as compiled by Landscape Garden Company shall be implemented by and at the cost of the owner/developer.
