RESOLVED UNANIMOUSLY

a. That the application for the removal of restrictive title deed conditions [clause D.2, D.3, G(c) and (d) to permit dwelling extensions on the property, BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions in attached Annexure A.

b. That the application for the deletion of conditions of an existing approval which read similar to the abovementioned restrictive conditions BE APPROVED in terms of Section 98(b)(i) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions in attached Annexure A.

c. That the application for relaxation of the 3.0m common boundary building line to 1.5m and 2.0m to permit dwelling extensions BE APPROVED in terms of Section 98 (b)(i) of the City of Cape Town Municipal Planning By-Law, 2015.
REASONS FOR DECISION:

Approval relating to the removal of restrictive title conditions:

1. That the removal of the restrictive title deed condition will not result in any financial or personal loss to the abutting neighbours or the applicants, as the proposal is considered minor in nature with an insignificant adverse impact on any primary rights of surrounding property owners.
2. The deletion of the previous township conditions will align the conditions applicable to the property with the title deed and the DMS.

Approval relating to the deletion of conditions:

3. It is considered that the proposal will not have an unacceptable adverse impact on the existing rights of the surrounding properties in terms overshadowing and loss of natural light, due to the position of objector’s property (Erf 10551) directly to the east of the applicant’s property.

Approval relating to the relaxation:

4. The proposal is unlikely to have any adverse impact on the amenity of the area or on the general aesthetic character of the streetscape in this area.
