RESOLVED UNANIMOUSLY
a. That the application for a temporary departure in terms of Section 42 (c) of the City of Cape Town Municipal Planning By-law to permit the sale of alcoholic beverages (off-consumption) on a portion of Erf 27928, Kraaifontein, BE REFUSED in terms of Section 98 (c) of the City of Cape Town Municipal Planning By-law, subject to the conditions stipulated in Annexure A.
b. That the application for a permanent departure in terms of Section 42 (b) of the City of Cape Town Municipal Planning By-law to permit nil off-street parking bays in lieu of 2 bays on Erf 27928, Kraaifontein, BE REFUSED in terms of Section 98 (c) of the City of Cape Town Municipal Planning By-law, subject to the conditions stipulated in Annexure A.
REASONS FOR DECISION:
1. A premises for the sale of alcoholic beverages (off-consumption) in the proposed location is not considered desirable within this higher-density residential context, as it would contribute to the negative social impact associated with alcohol use / abuse.
2. The proposed use will impact negatively on the health, safety and wellbeing of the surrounding community, as it will allow for the sale of alcohol, which could result in an increase in crime and anti-social behavior.
3. It is not considered that the limited contribution towards employment opportunities outweighs the potential negative social impact that the proposed use would have on the character of the surrounding residential area, specifically as the zoning of the property allows for other income-generating land uses which do not involve the sale of alcohol.
4. The proposal is not desirable as contemplated in terms of Section 99 (3) of the Municipal Planning By-law, 2015.
