RESOLVED UNANIMOUSLY

a. That the application for a permanent departure to permit a braai room on Erf 2300, Durbanville to be set back 3,3 m in lieu of 6 m from the northern common boundary as per the Site Plans No AS March 17-100, AS March 16-101 and AS March 17-103 attached per Annexure C, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015, subject to the conditions contained in Annexure A.

b. That the application for a permanent departure to permit a garage and outbuilding on Erf 2300, Durbanville to be set back 3,6 m in lieu of 5 m from the street boundary as per the Site Plans No AS March 17-100, AS March 16-101 and AS March 17-103 attached per Annexure C, BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-law, 2015.

c. That the application for a permanent departure to permit the width of a garage on the common boundary of Erf 2300, Durbanville to be 7,17 m in lieu of 6,5 m as per the Site Plans No AS March 17-100, AS March 16-101 and AS March 17-103 attached per Annexure C, BE REFUSED in terms of Section 98 (c) of the Municipal Planning By-law, 2015.

REASONS FOR DECISION:

The MPT APPROVED and REFUSED the application for the reasons set out in the Planner’s report.
