RESOLVED UNANIMOUSLY

That the application for consent to permit a day care for 20 children on Erf 156, Eversdal BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 in accordance with the conditions contained in Annexure A.

APPLICATIONS GRANTED IN TERMS OF SECTION 98(b) OF THE BY-LAW

Application 1.1 is amended as follows:

1.1 Consent to utilize the portion of the property for the purposes of a Place of Instruction for maximum of 20 children.


CONDITIONS TO BE IMPOSED IN TERMS OF SECTION 100 OF THE BY-LAW
Condition 2.1 is deleted.

Condition 2.4 is amended as follows:

2.4 That a revised SDP be submitted to the District manager for approval;
- Which shall locate the daycare facility central on the property so that the noise is mitigated to the greatest extent possible and noise generating activities are located towards the center of the property and away from the boundaries and;
- Access and egress are redesigned to optimize traffic movement and safety to the satisfaction of the Director: TDA

REASONS FOR DECISION:

1. Sufficient provision has been made for staff parking at the required parking ratio. The parking provision and access and egress arrangements can be more suitably reconfigured to the satisfaction of the relevant Departments.
2. The proposal is consistent with planning policy (i.e. Transit Oriented Development Strategy, Densification Policy, Economic Growth Strategy and Social Development Strategy).
3. The proposal is considered to be compatible with the City’s Early Childhood Development Policy, as important community infrastructure is provided in line with the guidelines this policy.
4. That the noise nuisance can be mediated by relocation of the part of the facility that is adjacent to the neighbor.
5. The proposal is not regarded to negatively impact on the engineering services.
6. That the Issues of health, safety and well-being of the surrounding community can be managed by imposing conditions to mitigate impact.
