UNANIMOUSLY RESOLVED that:
a. The application for a consent use in terms of the Municipal Planning By-Law, 2015 to allow a Freestanding Base Telecommunication Station on Erf 22218 Kensington BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015, subject to conditions.
b. The application for departure from the street building line on Erf 22218 Kensington BE REFUSED in terms of Section 98(c) of the Municipal Planning By-Law, 2015 subject to conditions.
REASONS FOR DECISION
The MPT REFUSED the application for the following reasons:
1. The applicants’ motivation contains misleading information
2. The site is highly visible and the proposal is to locate the mast right on the street boundary
3. The absence of a site plan makes it difficult for panel members to assess this application
4. A mast of this height is not appropriate in that location
5. No alternative sites have been considered or assessed
