UNANIMOUSLY RESOLVED that:

a. The application for amendment and removal of title deed conditions, as set out in Annexure A for Erf 2317 Oranjezicht, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, subject to the conditions contained in Annexure A.


b. The application to subdivide Erf 2317, Oranjezicht into two portions (Portion 1 [Remainder] ± 1 303 m²) and Portion 2 (± 593 m²) BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, subject to the conditions contained in Annexure A, as per Annexure C.

c. The application for departures from the wall plate height as set out in Annexure A, for Erf 2317 Oranjezicht, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, subject to the conditions contained in Annexure A, as per Annexure C.


REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following reason:

The motivation in the report for the removal of restrictions in the title deed is supported by the MPT.

Amend conditions:
Remove 2nd bullet point in 1.1
Delete the words ‘subdivide the property’ from 1.2
2.6.1 ‘Prior to transfer, the owner shall pay a financial contribution of R 36 642.09 towards the provision of bulk civil engineering services prior to building plan approval, with the amount determined by the Director TCT: Asset Management and Maintenance…’
Renumber 2.11 to number 3 with new heading as follows: ‘Conditions imposed in the title deed in terms of Section 100 of the Municipal Planning By-Law’
