UNANIMOUSLY RESOLVED that:
An administrative penalty in the amount of R 32 476.00 BE APPROVED for the building work in terms of Section 129 of the City of Cape Town Municipal Planning Amendment By-Law, 2016 in respect of erf 12811, Milnerton for the unauthorised recreation room, and such penalty be approved in terms of Section 98(b) of the said By-Law.
REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to add the following reasons:
- The contravention is very large.
- There are potential health and safety implications.
- The motivation does not explain the unauthorized use.
