RESOLVED UNANIMOUSLY that:
a. The application for rezoning of Remainder Erf 83355 and Erf 83744 Cape Town at Retreat from Local Business Zone 1 to General Business Subzone GB1, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.
b. The application for consolidation of Remainder Erf 83355, Erf 83744 and Erf 154729 Cape Town at Retreat, as per the plan of consolidation LUM/00/83355, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.
c. The application for departures, as set out in Annexure A, Remainder Erf 83355, Erf 83744 and Erf 154729 Cape Town at Retreat, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
d. The application for Council’s approval in terms of Item 60(k)(ii) of the Development Management Scheme, as set out in Annexure A, for Remainder Erf 83355, Erf 83744 and Erf 154729 Cape Town at Retreat, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law.
e. The application for the deletion of conditions of a previous approval, as set out in Annexure A, for Erf 154729 Cape Town at Retreat, BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015.
Condition 2.4.1 is amended as follows:
2.4 Development Contribution
2.4.1 Prior to the approval of any building plan relating to a block of flats, the owner/developer shall pay a development charge (DC) in accordance with the approved Development Charges Policy for engineering services for the City of Cape Town. The total amount payable for the proposed land use right is in accordance with the attached DC calculation is R512 857,97. This amount was valid until 30/06/2020 and the amount due will be escalated annually with the Construction Price Adjustment Formula (CPAF) using the industry indices of StatsSA.
Note: Failure to pay the full DC liability will be construed as non-compliance to the conditions of approval.
