It was RESOLVED that Subcouncil RECOMMEND to Council that:
-
Council resolve that, in terms of section 14 of the Local Government: Municipal Finance Management Act, Act 56 of 2003, the subject property being Erven 546 and 547 Langa, situated Washington Street, Langa in extent approximately 4 328 m², shown by the hatched figure lettered ABCDEFG, on the attached Plan 130008102, attached as annexure A to the report, is not required to provide the minimum level of basic municipal services; and has considered the fair market value of the asset and the economic and community value to be received in exchange for the asset;

Council grants in-principle approval in terms of regulation 5(1)(b)(ii) of the Municipal Asset Transfer Regulations for the transfer of Erven 546 and 547 Langa, situated Washington Street, Langa in extent approximately 4 328 m², shown by the hatched figure lettered ABCDEFG, on the attached Plan 130008102, attached as Annexure A to the report;

Council confirm that when considering the alienation of the land at less than market value, as provided for in terms of Clause 15.3 of Council’s Policy on the Management of Certain of the City of Cape Town’s Immovable Property, the contents of regulation 13(2) of the MATR has been duly taken into consideration;

Any gain or loss incurred by the City in respect of the transfer of the assets be included in the adjustment budget, if not budgeted for in the approved annual budget;

The transfer of Erven 546 and 547 Langa, situated Washington Street, Langa in extent approximately 4 328 m², shown by the hatched figure lettered ABCDEFG, on the attached Plan 130008102, attached to the report as Annexure A, to Uniting Presbyterian Church in Southern Africa, or its successor(s) in title, be approved, subject to the following conditions, that:

A purchase price of R250 000 excluding VAT be payable;

The purchase price is to escalate at 5% per annum compounded annually on a pro-rata basis commencing 6 months after date of valuation, i.e. from 1 July 2021 until date of registration.

That the market value be reassessed if the transaction is not approved within 24 months from date of valuation, i.e. 31 December 2022;

The sale be subject to a suitable reversionary clause limiting the use of the subject property to Community / Social Care / Place of Worship use, which restriction is to be registered against the title deed of the subject property.

Subject to such further conditions to be imposed by the Director: Property Management in terms of her delegated authority, inter alia the following:

that all further statutory and land use requirements be complied with;

The subject properties to be consolidated to form one single holding;
-
that all costs related and incidental to the transaction be borne by the purchasers.
