Resolution detail

It is recommended that the lease of portion of public street, being a portion of remainder Erf 4961 Francolin Street, Somerset West for gardening and Security purposes: Lurich Johannes Smith and Heather Alison Smith in Streets, Strand, shown hatched and lettered ABCDE on the attached plan ET 362 marked annexure A, in extent approximately 22 m², to Raimal Investments No 2 CC, owner of erf    8913, Strand or their successors in title, be approved subject  to inter alia the following conditions:
 

a.)A tariff rental of R1 177,39 per annum excluding VAT calculated at the rate applicable at the time of transaction be payable. Rates not applicable;

b.)The rental will be adjusted annually in terms of the rental tariff structure as approved by Council;

c.)The lease will endure for a period of 10 years, with an option to renew for a further ten years;

d.)The property be used to regularise an encroachment (retaining wall) only;

e.)Subject to such further conditions imposed by the Director: Property Management in terms of her delegated authority;

f.)Subject to compliance with any other statutory requirements.

g.)No compensation will be payable for any improvement made to the property.
