UNANIMOUSLY RESOLVED that:
a. The application in terms of Section 42(a) of the City of Cape Town Municipal Planning By-Law, 2015, for the rezoning of Erven 3258 & 3259, Parklands from Single Residential 1 (SR1) to Community Zone (CO1), BE APPROVED in terms of Section 98(b) (iii) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

b. The application in terms of Section 42(f) of the City of Cape Town Municipal Planning By-Law, 2015, for the consolidation of Erven 3258 & 3259, Parklands, BE APPROVED in terms of Section 98(b) (iii) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

c. The application in terms of Section 42(b) of the City of Cape Town Municipal Planning By-Law, 2015, for permanent departures for Erven 3258 & 3259, Parklands, BE APPROVED in terms of Section 98(b) (iii) of the City of Cape Town Municipal Planning By-Law, 2015, subject to the conditions contained in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to the following changes:

Correct reason 7.1.1 as follows:
7.1.1 The proposal is consistent with the requirements of Section 99 of the Municipal Planning By-Law, 2015, as elaborated on in Section 6 of this report

Amend reason 7.1.4 as follows:
7.1.4 The design of the buildings will remain overtly single residential in appearance and is considered to be contextually appropriate by way of its intended use and design. The place of instruction shall not operate over weekends and public holidays

Annexure A:
Amend condition 2.4 as follows:
2.4 The proposed place of instruction (school) shall not operate outside the hours of 07:00 to 18:00 on weekdays and shall not operate on weekends and public holidays
