UNANIMOUSLY RESOLVED that:
a. The application for consolidation of erven 10915 and 10916, Milnerton BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended) in accordance with plan no. Erf 10915/16- Table View Rev 1.4 dated 3 February 2022, subject to the conditions contained in Annexure A;

b. The application for permanent departures in respect of parking and floor factor for the consolidated erven 10915 and 10916, Milnerton as set out in Annexure A BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended) in accordance with plan no. Erf 10915/16- Table View Rev 1.5 dated 27 June 2022, subject to the conditions contained in Annexure A; and

c. The site development plan for the consolidated erven 10915 and 10916, Milnerton erf BE APPROVED in terms of Section 98(b) of the Municipal Planning By-Law, 2015 (as amended), subject to the conditions contained in Annexure A.

REASONS FOR DECISION
The MPT APPROVED the application for the reasons set out in the Planner’s Report and agreed to correct reason 7.1.10 as follows:

7.1.10 The proposed departure from the floor factor is compliant with Item 9.2 of the DMS and is not considered to be a threat to the character of an area earmarked for densification.

Annexure A:
Correct condition 1.3 as follows:
1.3 Departure in terms of Item 138 of the DMS to allow for 41 bays in lieu of 53 bays.

Correct condition 2.2 as follows:
2.2 Building plans must be submitted generally in accordance with plan. Erf 10915/16- Table View Rev 1.5 dated 27 June 2022, attached as annexure C with due cognizance of the conditions contained herein.

Correct condition 2.14 as follows:
2.14 The development must be limited to 35 flats. Should the number of flats be increased, a land use application must be made for which additional development contributions may be applicable.


Correct condition 2.30 as follows:
2.30 Implementation of the landscaping plan must be to the satisfaction of the Head: Environmental and Heritage Management. An on-site inspection must be arranged for this purpose with the Environmental and Heritage Management Branch on completion of such landscaping.
