RESOLVED UNANIMOUSLY that:
a. That the application for the rezoning in terms of Section 42(a) of the City of Cape Town Municipal Planning By-Law, 2015 of Unregistered Erf 542, Clara Anna Fontein, Durbanville from General Business Zone 1 (GB1) to Open Space Zone 3 BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.
b. That the application for the rezoning in terms of Section 42(a) of the City of Cape Town Municipal Planning By-Law, 2019 of Unregistered Erf 544, Clara Anna Fontein, Durbanville from General Business Zone 1 (GB1) to Subdivisional Area Overlay Zone BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 subject to the conditions contained in Annexure A.
c. That the application in terms of Section 42(d) of the Municipal Planning By-Law, 2015 for the subdivision of Unregistered Erf 544, Clara Anna Fontein, Durbanville to permit:
? 10 portions zoned Single Residential Zone 1(Portions 1 -10)
? 2 portions zoned Open Space Zone 3 (Portions 11 and 12)
BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 in accordance with Plan No. FP/0799/130/544 dated January 2021 attached Annexure C1, subject to the conditions contained in Annexure A.
d. That the application for departures in terms of 42(b) in terms of Municipal Planning By-Law, 2015 to permit the following:
In respect of Portions 2, 3, 4 and 9 (zoned Single Residential Zoning 1):
? A relaxation of the street building line from 3,5 m to 2 m
? A relaxation of the common building line from 3 m to 2 m
In respect of Portion 8 (zoned Single Residential Zoning 1):
? A relaxation of the street building line from 3,5 m to 2,5 m
? A relaxation of the common building line (between Portion 8 and Portion 7) from 3 m to 2 m
? A relaxation of the common building line (between Portion 8 and the commercial portion) from 3 m to 2 m
BE APPROVED in terms of in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 in accordance with Plan No. FP/0799/130/544 dated January 2021, attached as Annexure C2.
e. That the application in terms of Section 42(d) of the Municipal Planning By-Law, 2015 for the subdivision of Unregistered Erf 544, Clara Anna Fontein, Durbanville for the registration of a services servitude BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 in accordance with the attached Annexure C1.
f. That the application in terms of Section 42(i) of the City of Cape Town Municipal Planning By-Law, 2015, as provided for by Item 123 of the City of Cape Town Development Management Scheme, for the approval of the Site Development Plan (SDP) and Landscaping Plan (LP) BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-Law, 2015 in accordance with the attached Annexure C2.
