RESOLVED UNANIMOUSLY that:
a. The application for Rezoning of Portion 123 of Farm 311, Cape Farms, from Agricultural Zoning to Subdivisional Area Overlay Zoning to permit flats, a public road extension/widening and a sub-station, BE APPROVED, in terms of Section 98 (b) of the Municipal Planning By-law, 2015 (as amended in 2019) in accordance with Subdivision Plan No 19109-001 (Rev B; see Annexure C), subject to the conditions contained in Annexure A.
b. The application for Subdivision of Portion 123 of Farm 311, Cape Farms, into three (3) portions, namely a General Residential 2 (GR2) zoned portion for flats, an Utility zoned portion for a substation and one Transport 2 (TR2) zoned erf, BE APPROVED, in terms of Section 98 (b) of the Municipal Planning By-law, 2015 (as amended in 2019) in accordance with Subdivision Plan No 19109-001 (Rev B; see Annexure C), subject to the conditions contained in Annexure A.
c. That the application for approval in terms of the Development Management Scheme, in order to permit the approval of a Site Development Plan (including Landscaping Plan), BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 (as amended in 2019), in accordance with Site Development Plan No’s SDP01 (Rev F), SDP03 (Rev C), SDP04 (Rev C) (see Annexure D) & Landscaping Plan No LPD001 (Rev dated 1 September 2021; see Annexure E);
d. The application for Permanent departure from the street building line along the new Tennessee Street boundary from 4,5m to at least 3.3m, to accommodate some of the 3 storey blocks on newly `created portion 1 of Portion 123 of Farm 311, Cape Farms, BE APPROVED in terms of Section 98 (b) of the Municipal Planning By-law, 2015 (as amended in 2019), in accordance with Site Development Plan No SDP01 (Rev F), SDP03 (Rev C), SDP04 (Rev C) (see Annexure D), subject to the conditions contained in Annexure A.
Condition 1.3 is deleted and condition 2.11 is amended as follows:
2.11 That no access be permitted directly off Okavango Road or Langeberg Road during the construction phase as well as on completion of the development.
