RESOLVED UNANIMOUSLY
That an administrative penalty in the amount of R2 000.00 BE DETERMINED in terms of Section 129 of the City of Cape Town Municipal Planning By-Law, 2015 in respect of the unauthorised land use on Portion 1 of Cape Farm 1050 and Remainder Cape Point 1051, in relation to the use of the properties for an ‘animal care centre’, a curio shop, guided tours and a restaurant relating to an ostrich farm.
REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the Planner’s report except reason 6.6 which is amended as follows:
6.6 The owner of the properties has previously contravened the Land Use Planning Ordinance No 15 of 1985 in that the previous temporary departure was to legalize unauthorised uses. In addition, it must be noted that although the owner did not submit formal building plans relating to the use, and in doing so did not comply with a condition of the latest temporary departure approval.
