<h2 class="sectHeading">About</h2></span>
<p>The City’s Streets, Public Places and the Prevention of Noise Nuisances By-law regulates nuisances, municipal roads, public places, traffic and parking with reference to behaviour that the City considers aggressive, threatening, abusive or obstructive by persons in public.</p><h4>It was first promulgated in 2007 and there have been considerable developments since then, including, among others:</h4><ul><li>the expansion of the Peace Officer powers for Law Enforcement Officers in 2018; </li><li>the
<a href="https://resource.capetown.gov.za/documentcentre/Documents/Bylaws%20and%20policies/Streets_PublicPlaces_Amendment_By-law_2021.pdf" target="_blank">2021 amendment </a>addressing certain constitutional aspects; and </li><li>the need to adapt standard operating procedures in alignment with by-laws to ensure effective implementation.</li></ul><h4>The 2024 amendments seek to: </h4><ul><li>provide for a protocol with multiple levels, which will allow for additional procedural steps, such as a verbal directive followed by a Compliance Notice, before certain activities become offences and enforceable as such; </li><li> distinguish between more serious offences and those commonly and more directly associated with homelessness, rough sleeping or similar personal circumstances that can be reasonably regarded as vulnerable or involuntary. </li><li>address constitutional concerns and reduce adverse regulatory impact.</li></ul><p>Furthermore, the amendment deals with adding and contextualising procedural aspects in an inclusive manner that will guide necessary action while maintaining the need to:</p><ul><li>effectively resolve complaints and situations which may detract from the ordinary person’s rights to reasonable peace, enjoyment of public open spaces and facilities; and </li><li>mitigate risk to the City, individuals and land owners by ensuring that the necessary and ongoing processes/actions are supported by legislation.</li></ul><p> In terms of section 17 of the Local Government: Municipal Systems Act, Act 32 of 2000, you can submit comments to the municipality in respect of the draft Amendment By-law, 2024. </p><p>Access the draft
