Municipal Planning By-law amended to encourage development of affordable rental accommodation<span><p>'There is a dire need for affordable rental accommodation in Cape Town. The City recognises that the private sector is much better equipped to respond to this demand and that many micro- and small developers are already doing so. We need our MPBL to be responsive to Cape Town's changing built environment and unique social reality. Thus, we are proposing additions to the by-law to stimulate and enable development aimed at the affordable rental market in 194 selected residential areas,' said the City's Deputy Mayor and Mayoral Committee Member for Spatial Planning and Environment, Alderman Eddie Andrews.</p><p>The 194 areas identified for this proposed additional use right are those where, typically, state funded housing developments have been and are being implemented, and where the average household income is in the low- to mid-range.<br></p> <figure class="subtopic-fullsize-img"> <img src="https://resource.capetown.gov.za/cityassets/Media%20Images%202/194%20identified%20areas.png" class="responsive" alt="" style="width:2014px;" /> </figure>​​</span><p>'As such, the targeted areas are mostly in informal and lower income suburbs where you will find government subsidised housing developments. These areas have, over the past decade or so, experienced rapid densification in the form of formal backyarder dwellings, and other less formal structures. This form of housing delivery contributes to creating a vibrant township economy driven by people's own enterprise, ingenuity and investment and generates vital income for poor homeowners who put their property assets to productive use. Additional accommodation opportunities are created through a proposed additional use right for the development of an affordable rental flat on a property where only one dwelling unit or residential house has been developed.</p><p><strong>Proposed conditions for the development of an affordable rental flat as an additional use right:</strong></p><ul style="list-style-type:disc;"><li>Are applicable to properties that fall within the 194 identified areas</li><li>May be developed on a property where there is only one existing dwelling unit (house)</li><li>The number of affordable rental units or flats on a single property may not exceed 8 units plus a dwelling house, or a floor area of 160m²</li><li>The number of affordable rental units or flats on a single property may not exceed 12 units if no dwelling house exists on the land, or a floor area of 240m²</li><li>The height of the affordable rental unit or flat may not exceed 8m or two storeys</li><li>The construction of the affordable rental flat is subject to the payment of a development charge</li></ul><p> </p><p><strong>The 194 target areas include:</strong></p><p>Bellville, Beacon Valley, Belhar, Bishop Lavis, Brown's Farms, Bloekombos, Crossroads, Delft, Dunoon, Enkanini, Fisantekraal, Grassy Park, Gugulethu, Heideveld, Joe Slovo Park, Kommetjie, Kraaifontein, Khayelitsha, Kuyasa, Langa, Lavender Hill, Lentegeur, Lwandle, Mamre, Nomzamo, Nyanga, Ocean View, Parow Valley, Pelican Park, Philippi, Phoenix, Retreat, Westlake, Muizenberg, Hout Bay, Sea Winds, Sir Lowry's Pass, Strand, Strandfontein, Steenberg, Scottsdene, Saxonsea, Sun City, The Hague, Valhalla Park, Vrygrond, Wallacedene, Wetton, Witsand and Westridge in Mitchells Plain, among others. These are generally speaking lower income areas where the demand for affordable housing far outstrips the supply. With the right incentives we can unlock investment in the affordable rental market, and harness the capabilities of the private sector who can deliver on this demand much faster than government can. In the end, we need to do all we can to facilitate a more densified and inclusive housing market that provides lower income households and individuals with a wider choice of affordable accommodation across the city,' said Alderman Andrews. </p><p>The proposed amendments and new provisions to the Municipal Planning By-law are intended to also give effect to the spatial policies and strategies that the City Council has adopted since the last major revision in 2019.
