Resolution details

RESOLVED UNANIMOUSLY that:

a. The application for subdivision in respect of erven 20414, 14881 and RE-14882, Bellville into 2 portions each BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with the subdivision plans no C.0019-S1-01, C.0019-S2-01 & C.0019-S3-01, dated 11 April 2023, attached as Annexure C, subject to the conditions attached as Annexure A.

b. The application for rezoning of each portion 1 of erven 20414 and RE-14882, Bellville from Transport Zone (TR1) to General Industrial Zone (GI1), BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, subject to the conditions attached as Annexure A.

c. The application for consolidation in respect of erven RE-14867, 14876, 14877, 14878, 14873, portion 1 of 20414, portion 1 of 14882 and portion 1 of 14881, Bellville with a right of way servitude BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with the consolidation plan no C.0019-Consol-01 dated 11 April 2023, attached as Annexure D, subject to the conditions attached as Annexure A.

d. The application for consent use in respect of the newly consolidated erf to allow for a Container Site BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with the site development plan no 101 Rev B, dated 27 March 2023, attached as Annexure E, subject to the conditions attached as Annexure A.

e. The application for permanent departure in respect of the newly consolidated erf for a parking departure from the prescribed 408 bays to 274 bays and the increase of the permissible height of 18m to 24m for the warehouse BE APPROVED in terms of Section 98(b) of the Municipal Planning By-law, 2015, in accordance with the site development plan no 101 Rev B, dated 27 March 2023, attached as Annexure E, subject to the conditions attached as Annexure A.
Amended Condition

2.1.4. That the stacking of containers outside of the warehouse shall be limited to a height of 15m with appropriate screening to be implemented along Robert Sobukwe Road as per the landscaping plan implementation addressed under condition 2.1.15.

The word “he” be replaced by the word “the” in condition 2.1.14

REASONS FOR DECISION:
The MPT APPROVED the application for the reasons set out in the planner’s report, except reason 7.1.5 which is amended as follows:

7.1.5. The submitted Transport Impact Statement was evaluated by Council’s Transport Department who supports the application subject to conditions.
